During post-market studies to monitor cardiac events in users, data revealed an unacceptably high incidence of colorectal, lung, and pancreatic cancers in users of BELVIQ® and BELVIQ XR®.  As a result, the medications were withdrawn from the market on February 13, 2020

The FDA approved BELVIQ® in 2012, and BELVIQ XR® in 2016.  When combined with a reduced-calorie diet and increased physical activity, the medicines are intended to help with weight loss in adults.  The FDA advises that individuals using BELVIQ® and BELVIQ XR® discontinue use of the medication immediately and contact their physicians about alternate weight-loss medication IMMEDIATELY.

The FDA has made the recommendation that any unused medication be disposed of at your local take-back facility or to dispose of the medication as follows:

  1. Mix the pills with an unappealing substance such as dirt, cat litter, or used coffee grounds; do not crush them.
  2. Place the mixture in a container such as a sealed plastic bag.
  3. Throw away the container in your trash at home.
  4. Remove or delete all personal information on the medicine bottles or packaging, then throw away or recycle them.

For any BELVIQ® and/or BELVIQ XR® patients already diagnosed with colorectal, lung or pancreatic cancer the recall likely creates a legal obligation to file any existing claims within a specified time.  This time limit, referred to as the statute of limitations, can be as short as one year in some states.  Failure to file suit within your state’s applicable statute of limitations usually prevents you from being compensated for your injuries.  These same deadlines apply when a loved one has passed away due to their cancer diagnosis.  It is critical that these individuals seek representation immediately before their claims are time-barred.  Your time to file suit is running out!

Individuals who have not been diagnosed with cancer should take steps right away to preserve their medical and pharmacy records.  In the event you are diagnosed with cancer in the future, these records will be necessary to pursue a case.
